These Terms and Conditions (“Terms”) govern your use of our website located at https://patisserie-cherie.co.uk/ (“Website”) and the purchase of products through our third-party ordering platform, Storekit (https://order.storekit.com/patisserie-cherie/menu).

By accessing our Website or placing an order, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.

2.1. Nature of Goods

Our products are freshly baked and handmade. As such:

  • Appearance: While we take every care to ensure that our products match the descriptions and images provided, slight variations in appearance, size or decoration. Such variations do not constitute a defect and will not entitle the customer to a refund or replacement.
  • Perishability: Due to the perishable nature of our products, they must be stored in accordance with the instructions provided (e.g., refrigerated) and consumed within the timeframe recommended upon delivery (usually within 24-48 hours). We accept no liability for spoilage, deterioration, or changes in quality resulting from improper storage, handling, or failure to consume within the recommended timeframe. Except where required by law, we shall not be liable for any indirect or consequential loss arising from these circumstances.

2.2. Allergens (Important)

Patisserie Cherie handles nuts, gluten, dairy, eggs, and other allergens in our Pastry kitchen collection. While we take every precaution to prevent cross-contamination, we cannot guarantee that any product is 100% free from trace allergens.

  • Customer Responsibility: It is your responsibility to inform us of any dietary requirements or allergies before placing an order and to review the ingredient information provided.
  • Liability: We accept no liability for any adverse reactions or issues arising from failure to disclose such information or from not reviewing the ingredient details.
  1. Orders & Payments

3.1. Ordering Process

  • Order placement: Orders can be placed through our official website or by message (e.g., SMS or WhatsApp where available). Please ensure all details, including delivery address and contact information, are accurate before confirming your order.
  • Order acceptance: We reserve the right to accept or refuse any order at our sole discretion. Reasons for refusal may include, but are not limited to:
    • Lack of ingredient availability
    • Limited production capacity
    • Incorrect or incomplete customer information
    • Suspected fraudulent activity
  • Order confirmation: Once your order is submitted and accepted, you will receive a message confirming that we have accepted your order.

3.2. Pricing & Payment

  • Prices are displayed in GBP (£).
  • Shipping costs are calculated based on distance and added at checkout.
  • Payment in full must be completed at the time of order placement.
  • We will not start preparing your order until payment has been received.
  1. Cancellations, Refunds & Returns

Our policy regarding cancellations and refunds is strict due to the perishable nature of our goods. By accepting these Terms, you also accept our Return & Refund Policy, which includes:

  • No Returns: We do not accept returns on food items.
  • Cancellations:
    • For bespoke/special orders, no cancellations or amendments can be accepted once the order is confirmed (i.e., deposit paid).
    • For standard prepared to order pastry: 4+ Days Notice: Refund minus a 5% processing fee. Less than 4 Days Notice: No refund.
  • Defective Items: We take great care to ensure the quality and accuracy of your order. If you receive a damaged or incorrect item, you must report the issue within 24 hours of delivery. Reports must include clear photographic evidence of the defect or error. Please send your report to [insert contact method: email, phone, or messaging platform]. After review, we will advise on the next steps, which may include a replacement or refund at our discretion.
  1. Delivery & Collection

By accepting these Terms, you also accept our Shipping Policy.

  • Delivery Areas: Standard delivery is limited to Greater London. Areas outside this zone require prior approval and a custom quote.
  • Customer Availability: You must be available to receive the delivery during the agreed time window. If you are unavailable, and the courier, at their discretion, leaves the items in a safe place (at your risk) or returns them to the bakery, no refund will be issued.
  • Transfer of Risk: Risk in the products passes to you upon delivery to the agreed address or upon collection from our Pastry kitchen collection. Once the goods have been handed over, we are not liable for any loss, damage or deterioration occurring thereafter. r.
  • Liability: We accept no liability for any products that spoil, deteriorate, or become damaged due to the customer being unavailable to receive the delivery, providing an incorrect or incomplete delivery address, or failing to provide accurate delivery instructions. We shall not be liable for any delay or failure to deliver caused by circumstances beyond our reasonable control, including but not limited to courier delays, adverse weather conditions, traffic disruptions, strikes, accidents, or other force majeure events. Except where required by law, we shall not be liable for any indirect, incidental, or consequential loss arising from such circumstances.

All content on this website, including text, graphics, logos, and images of our cakes, is the property of Patisserie Cherie and is protected by applicable copyright and intellectual property laws. You may not copy, reproduce, distribute, or use any images or content for commercial purposes without our express written consent.

You must not use any content from our website, including images, text, or logos, in any manner that misrepresents our products, services, or brand, or that could reasonably be expected to harm our reputation. This includes, but is not limited to, altering images, creating misleading associations, or using our content in defamatory or offensive contexts. To the fullest extent permitted by law:

  • Indirect loss: Patisserie Cherie shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or products.
  • Liability cap: Our total liability for any claim arising out of or in connection with an order shall not exceed the purchase price of that order.
  • Non-excludable liability: Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, including negligence relating to food safety standards, or any other liability that cannot be excluded under applicable law.
  1. Force Majeure

We shall not be liable for any delay or failure to deliver caused by circumstances beyond our reasonable control, including but not limited to courier delays, adverse weather conditions, traffic disruptions, strikes, accidents, or other force majeure events. Except where required by law, we shall not be liable for any indirect, incidental, or consequential loss arising from such circumstances.

These Terms shall be governed and construed in accordance with the laws of England and Wales. Any disputes relating to these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
